BACI-NAHB and BRI October General Membership Meeting – “SCOTUS and the Changing Federal Regulatory Landscape”

Among the decisions made by the United States Supreme Court this year, two in particular have been hailed as sea changes when it comes to how federal agencies regulate businesses and individuals in the homebuilding and development industry and, potentially, any other business or organization being regulated at the federal level.

Sheetz v. El Dorado County changed the deference normally given by the courts to impact and usage fees if passed by a state or local legislature, while Relentless v. Dept. of Commerce and Loper Bright Enterprises v. Raimondo struck down the longstanding Chevron deference whereby courts deferred to federal agencies when Congress’s intent was ambiguous in terms of regulations. Both of them signal a very different regulatory environment, and the possibility of future successful legal challenges to burdensome or unwieldy federal regulations. We’ll be joined by Thomas Ward, the Vice President for Legal Advocacy for the National Association of Home Builders (NAHB) and James Tobin, CAE, the President and CEO of the National Association of Home Builders (NAHB) to discuss what these decisions mean for homebuilding and real estate, and what the federal regulatory landscape may look like after the Presidential election!
